Welcome to Treetop Mortgage. “Treetop Mortgage,” we mean the Treetop Marketing Group DBA and advertisements, marketing applications, marketing software, marketing departments, and services with the Treetop names or logos, inclusive of Treetop Marketing and Treetop Financing. A reference to “Treetop”, “we” or “us” is a reference to the relevant commonly branded operating company, website, or software in the Treetop Marketing group that is involved in the marketing activity.

These Terms of Use (“Terms”) govern your use of this website, TreetopMortgage.com and its partners and affiliates services, , including Treetop Marketing and Treetop Financing platforms (the “Websites”) that provide marketing services to real estate industry professionals, including leads and referrals, and additional resources (collectively, the “Services”). “Treetop” in these Terms means Treetop Marketing Group, Treetop Mortgage, Treetop Financing (also known as “Civet Holdings, LLC”). By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use this Website.

Treetop businesses and affiliated business relationship notices

We operate the following affiliated businesses arranged services, and any use of the services provided by these affiliated businesses is subject to these Terms. This is notice of the business relationships among the affiliated businesses. Our primary focus is to match homebuyers with realtors and other real estate professionals. Treetop Marketing Group’s owns and operates the website, webapp, and mobile app that offer and promotes Treetop’s homeownership education, affiliate marketing, related advertising and businesses services. Services offered by each of these businesses may be subject to additional terms available on their respective subdomains, websites, networks, mobile applications, or otherwise.

Treetop Homes affiliated business relationship notice

This is notice of the business relationships among the following affiliated entities: Real Estate Agents, Insurers, Business who provide services related to the real estate products or services, and experts who provide marketing and other related services to consumers.

1. Acceptance of terms

By accessing or using the Website, you accept and agree to these Terms and any additional policies referenced herein, including our Privacy Policy. Your continued use of the Website following any changes to these Terms signifies your acceptance of the updated Terms.

2. Eligibility

This Website is intended for use by individuals who are at least 18 years old and reside in the United States or its territories. By using the Website, you represent and warrant that you meet these eligibility requirements.

3. Services provided

Treetopmortgage.com provides access to integrated educational, marketing, advertising, and referral services, including search tools, loan information, and additional resources. This Website facilitates access to these services but does not provide any practical or direct loan originating, broker, mortgage, or lending services or products. This site, its partners, or affiliates also do not offer or provide real estate services or products, legal advice, financial advice, warranties or guarantees.

4. Changes to Terms of Use

We may revise and update these Terms from time to time in our sole discretion. Any changes are effective immediately upon posting. We encourage you to review the Terms periodically to stay informed of any updates.

5. Account registration and security

To access certain features, you may be required to create an account. By registering, you agree to provide accurate and current information and to update it as necessary. The information that you use to create a Treetop Account on one of our websites are the credentials you will use to authenticate with our network. You are responsible for maintaining the confidentiality of your account and any associated credentials. Notify us immediately of any unauthorized access or suspected security breach. Treetop is not liable for any loss or damage resulting from unauthorized access to your account.

6. Permitted use and license

You are granted a limited, non-exclusive, revocable, non-transferable license to access and use the Website and its content for personal, non-commercial purposes only. This license does not include any resale, distribution, public display, or other commercial uses of any content on the Website without Treetop’s prior written consent.

7. Prohibited uses

You agree not to use the Website in any manner that:

  • Violates any applicable federal, state, or local laws or regulations
  • Engages in fraudulent or deceptive practices
  • Promotes or enables any unlawful activity, including unauthorized access or hacking
  • Involves automated means, including bots, spiders, or scraping, to collect information or interfere with the Website without prior written permission
  • Transmits any unsolicited advertising or promotional material, including spam
  • Distributes viruses, malware, or any harmful code that may disrupt or damage the Website or other users’ systems
  • Impersonates any individual or entity or falsely represents an affiliation
  • Interferes with the Website’s security features or imposes an unreasonable load on the infrastructure of the Website

8. Intellectual property rights

The contents of this Site and Services, including their “look and feel” (meaning the content, trademarks, logos, text, graphics, images, button icons, software, editorial content, notices, and other materials on the Website) are the property of Treetop or its licensors, including its software or content suppliers, and are protected by copyright, trademark, patent, and other intellectual property laws. You may not use, copy, reproduce, modify, create derivative works from, or publicly display any part of the Website without express written permission.

Third-party trademarks, service marks, graphics, and logos used in connection with the Services are the intellectual property of their respective owners and are used for identification purposes only. Use of these names, trademarks, and logos does not imply a relationship with Treetop.

“REALTOR®,” “REALTORS®,” “REALTOR-ASSOCIATE®,” the “REALTOR®” logo are used on the Website to denote membership in the “National Association of REALTORS®” and, as such, providers of real estate related services consistent with a strict code of ethics and the highest standards of professionalism.

Treetop grants you the right to view and use the Services subject to these terms. You may download or print a copy of information for the Services for your personal, internal, and non-commercial use only. Any distribution, reprint, or electronic reproduction of any content from the Services, in whole or in part for any other purpose, is expressly prohibited without our prior written consent. You agree not to use, nor permit any third party to use, the Site or the Services or content in a manner that violates any applicable law, regulation, or this Agreement.

Feedback. If you provide any ideas, suggestions, or feedback related to Treetop’s services or materials (“Feedback”), you agree that Treetop and its affiliates may use that Feedback freely and for any purpose, without any obligation to you, including any intellectual property rights in the Feedback.

Materials License. You grant Treetop and its affiliates, agents, and licensees (“Authorized Persons”) a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, display, distribute, and create derivative works from:

  1. Any content you provide or that is captured from you while you are providing Feedback, such as statements, testimonials, images, videos, or audio (“Your Materials”); and
  2. Your name, image, likeness, voice, and other personal characteristics included in Your Materials (“Likeness”).

This license allows use in any format or media, now known or later developed, for purposes such as marketing, advertising, or promotional materials. You confirm that you have all necessary rights to grant this license.

Release. To the fullest extent allowed by law, you waive all claims against the Authorized Persons related to their use of Your Materials or Likeness. This includes claims for copyright or trademark infringement, invasion of privacy, defamation, or emotional distress, even if caused in part by negligence. You also waive any right to stop or limit use of Your Materials or Likeness, including through injunctive or equitable relief.

9. User contributions

The Website may allow you to post comments, content, or other materials (collectively, “User Contributions”). By posting any User Contributions, you grant Treetop a perpetual, non-exclusive, royalty-free, worldwide license to use, modify, reproduce, display, distribute, and otherwise exploit your User Contributions in connection with the Website.

You represent and warrant that:

  • You own or have the right to submit your User Contributions
  • Your User Contributions do not infringe any third-party rights, including intellectual property, privacy, or contractual rights
  • Your User Contributions comply with these Terms

Treetop reserves the right to review, monitor, and remove any User Contributions that violate these Terms or for any other reason at our discretion.

10. Third-party links and services

Treetop does not control, endorse, or assume any responsibility for the content, services, or privacy practices of any third-party websites or services. 11. Mobile applications

By accessing or using any mobile application (the “App”) associated with our Services, you acknowledge and agree to the following:

  • Device compatibility: You are responsible for ensuring that your mobile device is compatible with the App. We do not guarantee that the App will operate as intended on your device.
  • Data usage: Use of the App may require mobile data, and you may incur charges from your wireless provider. You are solely responsible for any such charges and for adhering to your wireless provider’s terms of service.
  • Updates and upgrades: We may release updates or upgrades to the App to improve functionality or address technical issues. These updates may be installed automatically or require manual installation. By using the App, you consent to receive and install these updates as necessary.
  • Third-party software: The App may include third-party software subject to open-source licenses. Any use of third-party software is governed by the terms of the applicable license. Our Terms of Use do not apply to such third-party software.

12. Disclaimer of warranties

THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREETOP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Treetop makes no warranty that the Website or Services will meet your requirements or that access will be uninterrupted, secure, or error-free. Any reliance on information provided through the Website is at your own risk.

13. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, TREETOP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. YOUR ACCESS TO OR USE OF THE WEBSITE

2. ANY CONTENT OBTAINED FROM THE WEBSITE

3. UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA

4. STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE WEBSITE

5. ANY OTHER MATTER RELATING TO THE WEBSITE

IN NO EVENT WILL TREETOP’S AGGREGATE LIABILITY EXCEED THE GREATER OF THE AMOUNT YOU PAID TO USE THE WEBSITE OR $100.

14. Indemnification

You agree to indemnify, defend, and hold harmless Treetop, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, judgments, losses, costs, or expenses (including attorneys’ fees) arising from your use of the Website, violation of these Terms, or your User Contributions.

15.Arbitration and dispute resolution

You understand and agree to resolve through final and binding arbitration any claims, disputes, or controversies related to the Telephone Consumer Protection Act of 1991 (“TCPA”) or any similar state laws, between you and Treetop, its parents, affiliates, subsidiaries, or related entities. TCPA-related claims will be arbitrated at a location determined by the arbitrator in accordance with the Governing Law provision. The arbitrator, not a court, will determine the scope of this arbitration provision.

Any judgment on an arbitration award may be entered in any court of competent jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act (“FAA”), with the laws of the State of Michigan governing the enforceability of this provision as a contract. TCPA claims must be brought individually; neither you nor Treetop may join or consolidate claims in arbitration, act as a class representative, or participate as a member of a class. Both parties waive any right to a jury trial for TCPA-related claims.

All other claims arising under these Terms or from use of the Website shall be resolved exclusively in the state or federal courts located in Detroit, Michigan, and you consent to the jurisdiction of these courts for such purposes.

16. Governing law

These Terms and any disputes arising from your use of the Website shall be governed by the laws of the State of Georgia, without regard to its conflict of law principles.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Treetop concerning your use of the Website, superseding any prior agreements or understandings.

Aggregated data

Information aggregation: Treetop Homes is not responsible for any errors in displayed information or delays in displaying information. Issues of data accuracy may be brought to the attention of Treetop Mortgage by sending feedback, but it is likely that such information accuracy cannot be corrected by Treetop Homes and the entity or person that generated the information must be appealed to. For example: Incorrect listing information can only be changed by the third-party listing agent under our terms with the Multiple Listing Services (“MLS”).

Days on site

The Days on Site value, displayed as “added X days ago” or “added to Treetop Homes X days ago” is derived from the date the listing was first displayed on the Site, not from the data in the MLS listing.

Referrals

Treetop does not guarantee or warrant the products or services of other product or service providers to whom it may refer you, including, but not limited to, real estate brokers/agents, lenders, and escrow/settlement companies.
